Welcome to Nomsy! These Terms of Service ("Terms") govern your use of the Nomsy mobile application and related services (collectively, the "Service") operated by Nomsy ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

Nomsy provides an AI-powered food tracking and nutrition analysis service that allows you to:

• Log food entries using photos, voice, or text descriptions
• Receive AI-generated nutritional estimates for your meals
• Track your daily calorie and macronutrient intake
• View historical data and trends about your eating habits
• Set and monitor nutrition goals

3. Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates any applicable law or regulation
• Upload or transmit any material that is unlawful, harmful, threatening, abusive, or otherwise objectionable

• Upload images that do not depict food or that contain inappropriate content

5. AI-Generated Nutritional Information

You acknowledge and agree that:

• Nutritional estimates are approximations and may not be 100% accurate
• Results may vary based on portion sizes, preparation methods, and ingredients
• The Service is not intended to diagnose, treat, cure, or prevent any disease
• You should consult a healthcare professional or registered dietitian for personalized nutritional advice
• We are not liable for any decisions made based on the nutritional information provided

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Nomsy and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content (such as food photos) that you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for the purpose of providing the Service to you.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

8. Account Termination

You may terminate your account at any time by using the "Delete Account" feature in the app settings. Upon termination:

• Your account will be deactivated immediately
• Your personal data will be deleted in accordance with our Privacy Policy
• You will lose access to all data associated with your account

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.

9. Limitation of Liability

To the maximum extent permitted by law, Nomsy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages resulting from your use of the Service
• Any decisions made based on nutritional information provided by the Service

In no event shall our total liability exceed the amount you paid us, if any, in the past twelve months for the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of nutritional information

11. Indemnification

You agree to defend, indemnify, and hold harmless Nomsy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Any content you upload to the Service
